Registration and Cancellation Policy

This Registration and Cancellation Policy applies to registrations for programs, training sessions, classes, camps, teams, clinics and other sporting activities offered by Cub de Lutte LaSalle (“the Organization”).

The Organization is a non-profit sports organization operating in Quebec. This policy is intended to comply with applicable Quebec law, including the Consumer Protection Act and the Civil Code of Québec. If any provision of this policy conflicts with a mandatory provision of applicable law, the applicable law will prevail.

1. Registration

A participant’s registration is considered complete once:

· the required registration information has been submitted;

· the participant or their parent/legal guardian, where applicable, has accepted the applicable terms and policies; and

· the required registration fee or payment arrangement has been received.

Registration is subject to available space and any eligibility requirements established for the applicable program.

2. Cancellation by the Participant Before the Program Begins

A participant may cancel their registration by providing the Organization with written notice of cancellation.

Where Quebec consumer protection legislation applicable to the registration provides that cancellation may occur without charge or penalty before the Organization has begun providing its principal services, no cancellation fee or penalty will be charged.

Any amount that the Organization is legally required to refund will be refunded within the period prescribed by applicable law.

3. Cancellation After the Program Has Begun

A participant may cancel their registration after the program has begun by providing written notice to the Organization.

Where sections 189 to 196 of Quebec’s Consumer Protection Act apply, the participant will be responsible only for:

the cost of the services already received, calculated according to the rate specified in the registration contract; and
a cancellation penalty equal to the lesser of:

o $50; or

o 10% of the price of the services that have not yet been provided.

Any remaining amount owed to the participant will be refunded in accordance with the time period prescribed by applicable law.

Example

If a participant registers for a season costing $500 and cancels after receiving 20% of the program, the calculation would be:

· Services already provided: $100

· Remaining services: $400

· Maximum cancellation penalty: 10% × $400 = $40

The Organization could therefore retain $140 and refund the remaining $360, assuming the applicable provisions of the Consumer Protection Act govern the registration.

4. How to Cancel

Cancellation must be communicated in writing.

A cancellation request may be sent by:

· email to clubdeluttelasalle@gmail.com

Where the Consumer Protection Act applies, cancellation takes effect when the written cancellation notice is sent, subject to the applicable legislation.

Participants are encouraged to retain a copy of their cancellation notice and proof that it was sent.

5. Refunds

Where a refund is required under Quebec law, the Organization will calculate the refund based on the services already provided and any cancellation penalty permitted by law.

Where sections 190 to 196 of the Consumer Protection Act apply, amounts owed following cancellation will be refunded within 10 days following cancellation, as required by law.

Refunds will normally be issued using the original method of payment whenever reasonably possible.

6. Administrative, Membership and Affiliation Fees

Certain amounts collected during registration may relate to third-party memberships, federation licences, insurance, competition licences or other external charges.

The Organization will identify these charges separately whenever practicable.

A fee will only be treated as non-refundable to the extent permitted by applicable law. Nothing in this policy is intended to remove or restrict a participant’s statutory cancellation or refund rights.

7. Uniforms and Equipment

Uniforms, clothing, equipment and other merchandise purchased separately from the sporting program are subject to the Organization’s merchandise return policy and applicable Quebec law.

Where the purchase is legally considered an accessory contract to the participant’s principal service contract, the cancellation rights provided by Quebec law will apply.

Customized, personalized or already-used items may be subject to different return conditions to the extent permitted by law.

8. Competitions, Tournaments and Special Events

Competition, tournament, travel, accommodation and special-event costs may include amounts paid by the Organization to third parties.

The Organization will clearly identify these charges whenever possible.

Refunds for these amounts will depend on the applicable contractual arrangements and Quebec law. The Organization will not designate an amount as “non-refundable” where doing so would conflict with a participant’s statutory cancellation rights.

9. Medical, Injury or Personal Circumstances

Participants who withdraw because of injury, illness or other personal circumstances should notify the Organization as soon as reasonably possible.

The Organization may request reasonable supporting documentation when a participant seeks a refund or accommodation beyond their minimum legal entitlement.

Nothing in this section limits cancellation or refund rights provided by Quebec law.

10. Cancellation of Activities by the Organization

The Organization may cancel or modify individual practices, classes, competitions or activities because of circumstances such as:

· facility closures;

· severe weather;

· safety concerns;

· coach or official availability;

· insufficient registration;

· public-health requirements; or

· circumstances beyond the Organization’s reasonable control.

Where reasonably possible, the Organization may offer a replacement session, alternative programming, credit or refund, depending on the circumstances and applicable law.

The Organization will not use this provision to restrict any mandatory rights available to participants under Quebec law.

11. Suspension or Removal for Conduct

Participation is subject to the Organization’s code of conduct, safety policies, disciplinary rules and applicable sport-governing-body requirements.

A participant may be suspended or removed where permitted by the Organization’s rules and applicable law for serious misconduct, harassment, violence, repeated violations of safety requirements or other conduct warranting disciplinary action.

Any financial consequences of suspension or removal will be determined in accordance with the participant’s contract and applicable Quebec law.

12. No Waiver of Legal Rights

Nothing in this policy is intended to waive, restrict or exclude rights that a consumer cannot legally waive under Quebec law.

Where the Consumer Protection Act, its regulations or the Civil Code of Québec provides a participant with greater cancellation or refund rights than this policy, those statutory rights will prevail.
